Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of BenHeath.AI ("the Service"), operated by Heath Media ("Heath Media", "we", "us" or "our"), a business based in the United Kingdom. By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Description of the Service

BenHeath.AI is an AI-powered search tool that answers questions by drawing on transcripts of Ben Heath's video content. When you ask a question, the Service generates a response grounded in those transcripts and cites the source material it relied on, so you can trace answers back to the underlying videos.

The Service relies on automated language models and transcript matching. While we aim for answers to be accurate and well-grounded, AI systems can make mistakes, omit context, or misinterpret a question. You should treat the Service as a research and reference aid, and verify anything important against the original videos and your own judgement.

2. Informational Use Only, No Professional Advice

The Service is provided for general informational purposes only. It does not constitute, and must not be relied upon as, professional, financial, legal, accounting, tax, marketing, or business advice.

Nothing in any answer creates an advisory, fiduciary, or professional relationship between you and Heath Media or Ben Heath. Advertising, marketing, and business outcomes depend on many factors outside our control. We do not guarantee any particular result, and ad results, performance, returns, or revenue are never guaranteed. Before acting on anything you read through the Service, you should seek advice from a suitably qualified professional and conduct your own due diligence. You are solely responsible for any decisions you make and any actions you take.

3. Accounts

Some features require you to create an account. When you register, you agree to provide accurate and complete information and to keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You must notify us promptly at tom@heathmedia.co.uk if you suspect any unauthorised use of your account. You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account. We may suspend or terminate accounts that breach these Terms, that we reasonably believe are being misused, or where required by law.

4. Free Tier

The Service offers a free tier. When you are logged out, you may submit up to three (3) queries per day. This limit resets on a rolling daily basis. We may change the limits, scope, or availability of the free tier at any time, and we may apply reasonable technical measures to enforce these limits.

5. Paid Subscription

For unlimited or expanded access, you can purchase a paid subscription at a price of $9.99 per month. The following terms apply to paid subscriptions:

By subscribing, you authorise us and Stripe to charge your payment method on a recurring basis. Your use of Stripe is also subject to Stripe's own terms and privacy policy. We may change subscription pricing or features from time to time; where we do, we will give you reasonable notice before the change takes effect, and any price change will apply from your next billing period.

6. Complimentary Accounts

Heath Media may, at its sole discretion, provide complimentary ("comp") access to the Service to certain accounts, for example for partners, reviewers, or promotional purposes. Complimentary access is offered as a courtesy, may be subject to additional conditions, and may be modified, limited, or withdrawn at any time without notice. Complimentary access confers no ongoing entitlement and creates no obligation on us to provide paid features free of charge in the future.

7. Acceptable Use

You agree to use the Service responsibly and only for lawful purposes. In particular, you agree that you will not:

You agree to use the Service only to a reasonable extent consistent with normal individual use. We may apply rate limits and other technical measures, and we may suspend or terminate access where usage is excessive, automated, or otherwise inconsistent with these Terms.

8. Intellectual Property

The underlying video content, transcripts, and related materials are the property of Ben Heath and are protected by intellectual property laws. Nothing in these Terms transfers ownership of that content to you. The Service software, design, and branding are owned by Heath Media or its licensors.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the answers generated by the Service for your own internal business purposes. This licence does not permit you to republish, redistribute, resell, or publicly reproduce the underlying transcripts or video content, or to present the outputs as a substitute for or competitor to the original content. All rights not expressly granted are reserved.

9. Availability and Changes

We aim to keep the Service available and reliable, but we provide it on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, error-free, or available at any particular time. The Service may be unavailable due to maintenance, technical issues, or factors outside our control.

We may add, change, suspend, or discontinue features, content, or the Service as a whole at any time. We may also update these Terms from time to time. Where changes are material, we will take reasonable steps to notify you, for example by email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

10. Limitation of Liability

To the fullest extent permitted by law, Heath Media, Ben Heath, and our respective officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, business, goodwill, data, or anticipated savings, arising out of or in connection with your use of, or inability to use, the Service or any reliance on its outputs.

To the fullest extent permitted by law, our total aggregate liability to you for all claims arising out of or relating to the Service or these Terms is limited to the greater of (a) the total amounts you paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred pounds sterling (GBP 100).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

11. Indemnity

You agree to indemnify, defend, and hold harmless Heath Media, Ben Heath, and our respective officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your breach of these Terms, your violation of any law, or your infringement of the rights of any third party.

12. Governing Law and Jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them or their subject matter, are governed by and construed in accordance with the laws of England and Wales. You and Heath Media agree that the courts of England and Wales have exclusive jurisdiction to settle any such dispute or claim.
